By accessing, registering with, or using WriteTheObituary.com (the "Service"), you agree to be legally bound by these Terms of Service ("Terms"). These Terms constitute a binding agreement between you and WriteTheObituary.com ("Company," "we," "us," "our"). If you do not agree to all terms and conditions, do not use this Service. We reserve the right to modify these Terms at any time. Continued use constitutes acceptance of modifications.

2. Service Description

WriteTheObituary.com is an AI-assisted obituary generation platform. We provide tools to help you create professional obituary drafts in multiple formats (short, long, death notice) based on biographical information you provide. The Service generates content using artificial intelligence and is intended as a starting point for professional obituaries. We do not guarantee editorial quality or suitability for publication.

3. User Registration & Accounts

To use the Service, you must create an account with accurate information. You are responsible for maintaining the confidentiality of your password and account credentials. You agree to all activity that occurs under your account. You must be at least 18 years old to use this Service. You agree not to create multiple accounts or impersonate another person. Accounts are non-transferable.

4. Pricing & Payment Terms

The one-time fee for obituary generation is $9.99 USD per draft. Payment is processed via Stripe and charged immediately upon confirmation. All prices are subject to change with notice. Prices do not include applicable sales taxes, which will be calculated and added at checkout. Payment failures may result in service suspension. All sales are final—no refunds are issued once content has been generated and delivered. Promotional pricing may be available at our discretion.

5. User Responsibilities & Conduct

You agree to use this Service only for lawful purposes and in a way that does not infringe upon the rights of others or restrict their use and enjoyment. Prohibited conduct includes: submitting false, inaccurate, or misleading information; defamatory or illegal content; harassment or abuse; violating intellectual property rights; unauthorized access to systems; or circumventing security measures. We reserve the right to suspend or terminate accounts that violate these provisions.

6. Content Ownership & License

You retain ownership of the obituary content generated using your biographical input. You may edit, publish, distribute, and use the generated obituary for personal, funeral, or memorial purposes. You grant us a limited, non-exclusive, royalty-free license to use generated content for service improvement, analytics, and anonymized aggregation. The WriteTheObituary.com platform, software, design, trademarks, and underlying technology remain our exclusive property. Reverse engineering, decompiling, or unauthorized copying is prohibited.

7. Data & Privacy

Your use is governed by our Privacy Policy. We automatically delete your draft and biographical data 30 days after export. Account information is retained until deletion. We do not sell personal information to third parties. We may use aggregated, anonymized data for service analytics. You are responsible for complying with all applicable laws regarding the information you provide, including rights of individuals named in obituaries.

8. Limitation of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT EXPRESS OR IMPLIED WARRANTIES OF ANY KIND, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT: (a) the Service will be uninterrupted, secure, or error-free; (b) generated content will be suitable for all uses or meet editorial standards; (c) any defects will be corrected; or (d) the Service is free from viruses or harmful components.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WRITETHEOBITUARY.COM, ITS OFFICERS, DIRECTORS, OR EMPLOYEES BE LIABLE FOR: (a) indirect, incidental, special, consequential, or punitive damages; (b) lost profits, data, or business interruption; (c) damages related to generated content quality or accuracy; or (d) any liability exceeding the total amount you paid for the service. Some jurisdictions do not allow liability limitations; applicable law will govern.

10. Indemnification

You agree to indemnify, defend, and hold harmless WriteTheObituary.com from any claims, damages, losses, or expenses (including attorney fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) biographical information you provide; (d) your obituary content; or (e) infringement of third-party rights related to your submission. We reserve the right to assume defense of any claim with counsel of our choice.

11. Service Modifications & Termination

We may modify, suspend, or discontinue the Service with or without notice. We reserve the right to terminate or suspend accounts for violation of these Terms, non-payment, or suspicious activity. Upon termination, your right to use the Service ceases immediately. Data deletion follows our Privacy Policy. We are not liable to you for modification or discontinuation of the Service.

12. Third-Party Services & Links

The Service may include links to third-party websites, payment processors, and services. We are not responsible for third-party content, accuracy, or practices. Your use of third-party services is governed by their terms and privacy policies. We do not endorse or assume liability for third-party services. Payment processing through Stripe is subject to Stripe's terms.

13. Intellectual Property Rights

WriteTheObituary.com, including logos, service marks, copyrights, and patents, are the exclusive property of the Company. You may not use our intellectual property without permission. User-generated content (biographical input) retains your copyright, but you grant us rights to use it as described in Section 6. Unauthorized use of our intellectual property may violate copyright, trademark, and other laws.

14. Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of California, USA, without regard to conflicts of law principles. Any legal action or proceeding must be brought exclusively in the state or federal courts in California. You consent to personal jurisdiction in these courts. Any dispute shall be resolved individually without class action or arbitration unless agreed otherwise.

15. Severability & Entire Agreement

If any provision of these Terms is found invalid or unenforceable, that provision will be modified to the minimum extent necessary, and the remainder will remain in effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements.
